My ureter was injured during myomectomy

Please forward this inquiry to Dr. Mishra.

In 2018, I was supposed to have a laparoscopic hysterectomy for fibroids. My ovaries and cervix were supposed to be maintained. Unfortunately, the surgeon severed my right ureter completely and lacerated my bladder. It was identified during surgery and repaired by urology. Unfortunately, my recovery was complicated by UTI, subsequent cystoscopy to rule out fistula, terrible abdominal scarring, and urinary incontinence.
The uterus was estimated to be the size of 16 weeks gestation. During surgery, it was noted that I had significant adhesions in the right abdomen (no prior abdominal surgery) and the right ovary was adhered to the uterus. In addition, a fibroid was growing into the cervix. As I understand, these are all risk factors for urologic injury and she proceeded without placing ureteral stent intraoperatively.

I started crying when I first watched your video with the ureteral stent placement because I believe it could have prevented the injury and the depression and anxiety I have almost 5 years later.

I am in the process of litigation against the surgeon. I hope and pray that she will think twice in the future and prevent injury to another person.

I have tried to get another surgeon to review my case and provide a sealed affirmation that there was a departure from appropriate care. I believe in my heart that if she had placed the ureteral stent intraoperatively, the injury would not have occurred.

Unfortunately, here in the US, and especially in New York, I am unable to get a surgeon to attest to it as they seem to be reluctant to speak against another surgeon even though it would be a sealed document for only the Judge to review.
I am reaching out to you because I see that you are a world-renowned surgeon with exceptional expertise in this area. In addition, you appear to be committed to preventing injury and promoting education. I believe you are my last hope.
I am a registered nurse with greater than 30 years experience. I am currently working as a palliative care coordinator at a community hospital.

I hope and pray that you may consider reviewing my medical records and perhaps provide an expert opinion. I hope that you receive this request. Please let me know if it is possible and how much the consultation would cost so I may be able to secure the financial resources.

Dear Laura,

Thank you for reaching out to me regarding your medical situation. I understand the distressing experience you went through during your laparoscopic hysterectomy in 2018, and I empathize with the physical and emotional challenges you have faced since then.

As a surgeon, I appreciate your trust in my expertise and commitment to patient safety. However, please understand that providing legal assistance or expert opinions in ongoing litigation cases is beyond the scope of my professional responsibilities. It is important to maintain impartiality and avoid conflicts of interest. However, I will send you the literature in support of the ureteric stent.

In situations like yours, I recommend consulting with a legal professional who specializes in medical malpractice cases. They will have the necessary knowledge and resources to guide you through the legal process, evaluate your case, and connect you with qualified medical experts who can provide objective opinions based on a thorough review of your medical records.

I understand your frustration in finding a surgeon to review your case and provide an affidavit. It can be challenging to obtain expert opinions, particularly when there are concerns about professional dynamics and potential conflicts. However, a skilled legal team will be familiar with the appropriate channels to navigate and can help identify suitable experts who can evaluate your case objectively.

I encourage you to reach out to a medical malpractice attorney who can assist you in pursuing the legal recourse you seek. They will guide you through the necessary steps and ensure your rights are protected throughout the process.

I wish you the best of luck in your pursuit of justice, and I sincerely hope that your experiences contribute to improvements in patient care and safety. If there is any way I can provide general medical guidance or support within the boundaries of my professional role, please do not hesitate to ask.

Warm regards,

R. K. Mishra
